User agreement

The Customer Portal is provided to you via the internet by Mosaic World. The following conditions are attached to the use of the Customer Portal Portal. By using the Customer Portal, you agree to them.

Deviations from these Terms of Use are only binding if accepted by Mosaic World in writing.

Article 1. Registering on the Customer Portal

1.1. On the Customer Portal you can arrange your accommodation online. 

1.2. To use the Customer Portal, you must register. You do this by supplementing the data already known about you at Mosaic World with some additional data. You will be asked to check your details and accept these Terms of Use. Once you have done so, you will receive an activation code by SMS on the mobile number provided. This activation code activates your registration on the Customer Portal. After the registration is completed, you can use your e-mail address and a password to log in directly to your account.

1.3. As your account contains a lot of personal data, it is important to protect access to this data from unauthorised persons. In particular, you must keep your password strictly confidential. Mosaic World may assume that everything that happens from your account after logging in with your user name and password occurs under your direction and supervision. You are therefore liable for all such actions, except in the force majeure situation where unauthorised persons have gained access to your password without your knowledge. If you become aware of this, report it to Mosaic World immediately.

Article 2. Rules of use

2.1. You are not allowed to use the Customer Portal in a way that violates any laws or regulations.

2.2. In addition, it is prohibited via the Customer Portal:

  • disseminate or store information that is defamatory, libellous or racist;
  • disseminating information in violation of any intellectual property right, or posting hyperlinks to such information;
  • disseminate information that is erotic or pornographic (even if legal in itself);
  • use indecent language;
  • violate the privacy of third parties, for example by distributing third parties' personal data without permission or necessity or by repeatedly harassing third parties with communications unwanted by them;
  • assisting others in violating the rights of third parties, such as by linking to hacking tools or computer crime explanations apparently intended to enable the reader to commit the described criminal conduct and not to defend themselves against it;
  • and to do anything else that violates netiquette.

2.3. Upon detection of a violation of the above conditions, Mosaic World shall be entitled to intervene. 

2.4. If, in Mosaic World's opinion, there is a nuisance, damage or other danger to the computer systems or the network of Mosaic World or third parties and/or to the provision of services via the Internet - in particular due to excessive sending of e-mail or other data, leaks of personal data or the activities of viruses, Trojans and similar software, - Mosaic World shall be entitled to take all measures it reasonably deems necessary to avert or prevent such danger.

2.5. You are responsible for the content you post. You therefore indemnify Mosaic World against all claims of third parties in connection therewith.

2.6. Remember that Mosaic World may also report criminal offences.

Article 3. Maintenance and availability

3.1. Mosaic World makes every effort to keep the Customer Portal available, but does not guarantee uninterrupted availability.

3.2. Mosaic World actively maintains the Customer Portal to provide optimal services. If maintenance is expected to result in any limitation of availability, Mosaic World will carry it out at the time when usage of the Customer Portal is relatively low. Maintenance will be announced in advance if possible. Maintenance in connection with calamities may take place at any time and will not be announced in advance.

3.3. Mosaic World may modify the functionality of the Customer Portal from time to time. In doing so, your feedback and suggestions are welcome, but ultimately Mosaic World itself decides which adjustments it will make or not.

Article 4. Fee for the Customer Portal

The Customer Portal is offered to you entirely free of charge.

Article 5. Intellectual property

5.1. The Customer Portal, all information and images on the Mosaic World website as well as the associated software are the intellectual property of Mosaic World or its licensors. These may not be copied or used in any way without the separate written consent of Mosaic World, except in those situations where permitted by law.

5.2. Information that you publish or store through the Customer Portal is and shall remain your property. Mosaic World has a right of use to use this information for the Customer Portal and anything related to it, including advertising about the Customer Portal.

5.3. You grant the right of use from the previous paragraph to Mosaic World for an indefinite period of time. The right of use continues even after termination of the agreement. In exceptional cases where there is a compelling interest against continued use of the information, Mosaic World may decide to amend or remove it.

5.4. You may modify information that you publish or store via the Customer Portal as you see fit. However, deletion is not possible.

5.5. Mosaic World will not take cognisance of any private data that you store and/or distribute via the Customer Portal, such as, for example, e-mails to potential new tenants, unless this is necessary for the proper provision of services or if Mosaic World is obliged to do so under a statutory provision or court order. In such case, Mosaic World shall make every effort to limit knowledge of the data as much as possible, insofar as this is within Mosaic World's power.

Article 6. Personal data

When using the Customer Portal, your personal data will be processed. You consent to all forms of processing that fall within the scope of the service. Consult Mosaic World's privacy statement for more information.

Article 7. Duration of the Agreement and account termination

7.1. By registering on the Customer Portal, you enter into an agreement with Mosaic World. This agreement starts as soon as you use the Customer Portal for the first time and runs for an indefinite period of time.

7.2. Termination of the agreement is possible if you no longer use Mosaic World's accommodation.

7.3. You can terminate your Customer Portal account by contacting Mosaic World. The contact details can be found at the bottom of these Terms of Use.

Article 8. Liability

8.1. You are solely responsible for the actions you take on and through the Customer Portal.

8.2. In the event of damage whose occurrence is directly related to the Customer Portal, Mosaic World will compensate the user for a maximum amount of €500.00 (say five hundred euros) per user.

8.3 A condition for the creation of any right to compensation is that you report the loss in writing to Mosaic World no later than two months after the discovery of the loss-causing event.

8.4. In the event of intent or gross negligence on the part of Mosaic World, the limitation set out in Article 8.3 shall not apply.

8.5. Under no circumstances shall Mosaic World be liable for indirect damage such as, but not limited to, consequential damage.

8.6. In the event of force majeure, Mosaic World shall never be obliged to compensate any damage suffered by you as a result. Force majeure shall include, inter alia, disruptions or breakdowns of the Internet, the telecommunications infrastructure, power failures, civil commotion, mobilisation, war, traffic jams, strikes, lockouts, operational disturbances, delays in supply, fire and floods.

Article 9. Amendment of Terms of Use

9.1. Mosaic World may amend these terms and conditions at any time.

9.2. Mosaic World shall announce the amendments or additions at least thirty days before they take effect via the Customer Portal so that you can take note of them.

9.3. If you do not wish to accept a change or addition, you can cancel the Agreement until the date of entry into force. Use of the service after the date of entry into force is deemed to be acceptance of the amended or supplemented terms and conditions.

Article 10. Remaining provisions

10.1. The Rental Conditions apply to the online conclusion of a rental agreement. These will be provided via the Customer Portal prior to the conclusion of the rental agreement.

10.2. The use of the Customer Portal and these Terms of Use are governed by Dutch law.

10.3. Unless otherwise prescribed by the rules of mandatory law, all disputes in connection with the Customer Portal shall be submitted to the competent Dutch court for the district in which Mosaic World has its registered office.

10.4. If a provision in these Terms of Use or within the Customer Portal requires that a communication must be made "in writing", it is also satisfied if the communication is made by e-mail or communication via the Customer Portal, provided that it has been sufficiently established that the message actually comes from the alleged sender and that the integrity of the message has not been compromised.

10.5. The version of communication or information as stored by Mosaic World shall be deemed to be correct, unless you provide evidence to the contrary.

10.6. If any provision in these Terms of Use is found to be invalid, this shall not affect the validity of the entire Terms of Use. In such case, the parties shall adopt (a) new provision(s) by way of replacement, which will give shape to the intention of the original provision as much as is legally possible.

10.7. Mosaic World shall be entitled to transfer its rights and obligations to a third party who takes over the relevant activity from it.
